| Freedom-to-Operate (FTO) analysis or Clearance search |
Freedom-to-operate analysis or FTO analysis is used to determine whether a particular action, such as testing or commercializing a product, can be done without infringing valid intellectual property rights of others. The search scope includes enforced patents, published pending patent applications, and expired patents (as potential clearing documents) followed by full review of claims of the most relevant located patents (usually 20 years from the date of search).
